General Terms and Conditions

Scope of Application

The offer of obituary.design is intended for private use by private persons for informing relatives and friends. Any further or different use requires the consent of the provider.

Any use beyond personal, non-commercial purposes requires explicit consent from the provider. Automated retrieval of obituaries from the obituary.design directory by third parties is strictly prohibited without prior written permission.

Conclusion of Contract

The contract between the customer and the provider is concluded when the customer successfully places an obituary on the website and completes the associated payment.

Provider's Services

Upon payment of the posting fee, the obituary remains accessible on obituary.design for a period of 12 months. After this period, the obituary may be archived or removed from public view. Customers may request an extension of the display period for an additional fee.

Customers may request the deletion of their advertisement at any time by emailing mail@obituary.design.

obituary.design reserves the right to remove or modify obituaries without prior notice or explanation, particularly if they violate applicable laws, decency standards, or these terms of service. The provider assumes no liability for improperly posted obituaries or any consequences arising from their publication or removal.

Customer Obligations

The customer is responsible for ensuring that all image and text material submitted in the obituary does not infringe upon the copyrights or other intellectual property rights of third parties. The customer must obtain consent from any individuals whose name, contact details, or address are mentioned in the advertisement before publication.

Customers are required to provide accurate and truthful information in their obituaries. The following content is strictly prohibited:

  • Offensive, discriminatory, or hate speech
  • False or misleading information
  • Content that violates the privacy or rights of others
  • Any material that is illegal or promotes illegal activities

Intellectual Property

All intellectual property rights to the advertisement content composed or uploaded by customers on obituary.design remain with the customer. However, by using our service, the customer grants the provider a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content for the purposes of providing and promoting the service.

The intellectual property of all templates, texts, images, and illustrations provided by obituary.design remains with the provider. The provider grants the customer a non-exclusive, non-transferable right to use these contents solely for the purpose of creating and displaying obituaries on our platform.

The provider reserves the right to moderate, edit, or remove any user-generated content that violates these terms or any applicable laws.

Refund Policy

Given the immediate and digital nature of our service, refunds are generally not provided for obituary postings. Once an obituary is published on our platform, the service is typically considered fully delivered. We strongly encourage customers to carefully review their obituary content and design before finalizing their order and making payment.

In exceptional circumstances, refund requests may be considered on a case-by-case basis, subject to applicable laws in your jurisdiction. Any refund, if granted, will be at the sole discretion of obituary.design. By completing the purchase, you acknowledge and agree to these terms regarding our refund policy.

Service Availability and Maintenance

While the provider strives to ensure continuous availability of the service, obituary.design does not guarantee uninterrupted access to the platform. The service may be occasionally unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue the service, either temporarily or permanently, with or without notice.

In the event of planned maintenance that may cause significant service interruption, we will make reasonable efforts to notify users in advance. However, emergency maintenance or unforeseen technical issues may require immediate action without prior notice.

The provider shall not be liable for any loss, damage, or inconvenience caused by the unavailability of the service, whether for scheduled maintenance or due to unforeseen circumstances.

Changes to the Service

The provider reserves the right to make changes to the service, including but not limited to features, functionality, and pricing. For significant changes that may affect user experience or rights, we will make reasonable efforts to provide advance notice through the website or via email to registered users.

Severability Clause

If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected. Instead of the invalid or unenforceable provision, a regulation shall apply that comes closest to the meaning and purpose of the original provision in legal and economic terms.

Applicable Law and Jurisdiction

The exclusive jurisdiction for all disputes arising from or in connection with these Terms and Conditions is the location of the provider.
